How are control assets divided in a divorce case? Digital asset, like any other asset that is acquired during the marriage, is subject to division. Here in Georgia, we are an equitable division, not necessarily an equal division state. Equitable means what’s fair. Digital assets, like any other asset, go on the marital balance sheet. However, some digital assets are unique so that both parties can walk away with the whole set. Think photos, think videos.
